3-YEAR WARRANTY
1. Ghidini Lighting S.r.l. (“Ghidini”) warrants that standard products bearing the Ghidini and Lucitalia trademarks listed in the catalogue (“Products”), when used in accordance with their intended purpose, are free from manufacturing and/or material defects for a period of 3 (three) years from the invoice date.
2. Any repair or replacement carried out shall not extend the original warranty period.
3. The warranty exclusively covers the functionality and safety of the Product under normal conditions of use.
4. The warranty shall apply only if all of the following conditions are met:
4.1 Any defect must be reported in writing by the Customer within 15 (fifteen) days from delivery of the Products or, in the case of non-apparent defects, from their discovery. The notice, to be sent together with a copy of the purchase invoice and transport documents, must indicate the delivery date and be supported by all appropriate evidence, including photographic evidence, of the reported defects and the quantity of defective Products.
4.2 The Products are used in compliance with the technical specifications provided by Ghidini.
4.3 Installation and assembly are carried out by qualified technical personnel and in accordance with the instructions supplied with the Product.
4.4 The Products are installed on systems equipped with surge protection devices (SPD).
4.5 The limits of temperature, voltage and mechanical load indicated in the technical data sheets are not exceeded and, for outdoor products, the following conditions are complied with:
4.5.1 Daytime temperature must not exceed 60 °C when the Products are switched off.
4.5.2 Night-time maximum temperature must not exceed the values indicated in the technical data sheet.
4.5.3 Night-time minimum temperature must not be lower than –20 °C (minus twenty degrees), unless otherwise specified in the technical data sheet.
4.5.4 Switching cycles must occur on a daily basis and the average operating time must not exceed 4,400 hours per year.
4.5.5 The Products must not be switched on earlier than 30 minutes after sunset and must be switched off at least 30 minutes before sunrise.
4.6 The lamps used comply with the IEC specifications in force at the time of purchase.
4.7 Class III Products are used exclusively with electronic power supplies tested and supplied from the Ghidini catalogue.
4.8 Maintenance is carried out by specialised personnel, in compliance with the instructions and without unauthorised modifications.
4.9 The Customer has carried out all preliminary operations provided for in the Product manual.
4.10 The Product deemed defective is kept in its current condition (including the light source) until completion of the checks by Ghidini.
4.11 The Customer provides the purchase contract or the relevant invoice.
4.12 The Customer has duly paid for the Product in accordance with the agreed contractual conditions.
4.13 The warranty is valid worldwide, excluding the following countries: USA and Canada.
4.14 The maximum nominal ambient operating temperature of the Products must be 25 °C, unless otherwise specifically indicated in the technical data sheet.
5. LED sources and power supply components: for these elements, the warranty covers up to 13,200 hours (12 h/day). It applies only to defects exceeding the nominal failure rate (0.2% / 1,000 h), unless otherwise specified in the technical specifications. Luminous flux depreciation up to 0.6% / 1,000 h and photometric variations are normal phenomena and are not covered by the warranty.
6. In the event of defects covered by the warranty and subject to verification of the conditions set out in point 4, Ghidini may, at its sole discretion and within a reasonable time, repair or replace the Product with an identical or equivalent one, taking technological evolution into account. Replaced materials shall remain the property of Ghidini.
7. THE WARRANTY DOES NOT COVER:
7.1 Defects due to force majeure or fortuitous events (including electrical discharges and lightning).
7.2 Defects caused by surges exceeding the values indicated in IEC 61000-4-5:2005-11.
7.3 Transport damage.
7.4 Installations or uses not compliant with the intended use.
7.5 Damage caused by polarity inversion or improper connections.
7.6 Water ingress damage caused by lack of drainage or residues preventing correct closure of the Product.
7.7 Damage due to causes not attributable to the manufacturer (abrasions, scratches, contact with chemical agents, etc.).
7.8 Damage resulting from connections with a protection rating lower than that of the Product.
7.9 Limescale stains or deposits resulting from irrigation systems.
7.10 Damage caused by high-pressure washing.
7.11 Damage due to poor maintenance or repairs not carried out in accordance with instructions.
7.12 Paint defects caused by contact with soil, chemical substances, water containing corrosive agents, abrasion or impacts.
7.13 Damage caused by impacts with sports equipment.
7.14 Temporary condensation that does not compromise safety and functionality.
7.15 Use beyond the technical limits indicated on the Product data sheet.
8. THE WARRANTY DOES NOT COVER:
8.1 Ancillary costs (disassembly, reassembly, installation, disinstallation, transport, disposal, site access).
8.2 Parts subject to normal wear and tear (non-LED light sources, batteries, mechanical parts), nor software, viruses or bugs, etc.
8.3 Products not bearing the Ghidini trademark marketed by the company, for which Ghidini recognises the warranty provided by law.
8.4 Light Management Systems, for which Ghidini recognises the warranty provided by law.
9. Outdoor Products are covered by the warranty only if any defects compromise safety and structural integrity and are attributable to manufacturing defects.
10. This warranty fully replaces any other statutory or contractual warranty and excludes any further liability of Ghidini towards the Customer. Under no circumstances shall Ghidini be liable for loss of turnover, damage to image, or other direct or indirect damages arising from defects in the Products. Any liability for damage to persons, property or animals caused by non-compliance, by the Customer or third parties, with the instructions for use is also excluded.
11. The Customer may not claim any further compensation in relation to the defective Product, nor suspend payments or obtain price reductions or termination of the contract.
12. Ghidini reserves the right to amend this Warranty at its sole discretion and at any time. Any amendments shall apply exclusively to Products invoiced as from the effective date of the amendment.
13. The warranty shall automatically lapse in the event of modifications or repairs not authorised in writing by Ghidini.
14. Governing law: this warranty is governed by Italian law. Exclusive jurisdiction: Court of Brescia. For matters not provided for herein, reference is made to the general conditions of sale.
